1. AI Services & Accuracy Disclaimer

Note on AI Accuracy

Pandanote uses advanced Artificial Intelligence to help you study. While highly capable, AI can sometimes make mistakes. We recommend simply verifying important details, just as you would with a human study buddy.

  • No Reliance: You agree to independently verify all summaries, flashcards, and answers generated by the AI before using them for exams, professional work, or decision-making.
  • No Medical/Legal Advice: The AI features must not be used as a substitute for professional medical, legal, or financial advice.
  • Input Responsibility: You are responsible for ensuring your input content (audio/text) allows for accurate processing and does not violate third-party rights.

2. Recording Policy & Legal Compliance

Pandanote is a tool for personal study and productivity. You must use it in compliance with all applicable laws.

  • Two-Party Consent Laws: In many jurisdictions (including several US states), it is illegal to record conversations without the consent of all parties. You are solely responsible for obtaining necessary consents before recording.
  • Institutional Policies: You must adhere to the recording policies of your university, school, or workplace.
  • Prohibited Content: You may not upload content that is illegal, hate speech, or promotes violence.

3. Right of Withdrawal / Cancellation Waiver

For Digital Services: By creating an account and subscribing, you acknowledge and accept that the Service provides immediate access to digital content and AI processing.

To the maximum extent permitted by applicable law (including EU/UK Consumer Rights Directives), you expressly waive your right of withdrawal (cooling-off period) once the digital service has started processing your data or providing access to features.

4. Payments, Subscriptions & Refunds

Mobile Subscriptions (Apple/Google)

Transactions made via the iOS App Store or Google Play Store are handled entirely by Apple or Google.
We cannot issue refunds for mobile purchases. You must contact Apple or Google support directly to request a refund, subject to their policies.

Web Subscriptions (Lemon Squeezy)

For web payments, our "Merchant of Record" is Lemon Squeezy.

  • 14-Day Satisfaction Guarantee: If you are unhappy with the service, you may email support@pandanote.app within 14 days of your initial purchase for a refund review.
  • Strict Exclusions: We do NOT provide refunds for:
    • Inactive accounts (forgetting to cancel).
    • Terms of Service violations (e.g., abuse of the system).
    • Renewals where you failed to cancel 24 hours prior.

5. Acceptable Use Policy (AUP)

You agree strictly NOT to:

  • Use any automated system (robots, spiders, scrapers) to access the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Upload malware, viruses, or code designed to disrupt the Service.
  • Use the Service to harass, abuse, or harm others.
  • Share your account credentials with multiple people (account sharing is prohibited).

6. Limitation of Liability & Indemnification

  • "As Is" Service: The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uptime or error-free operation.
  • Liability Cap: To the maximum extent permitted by law, HUMANOVA LABS LLC's total liability to you for any claims shall be limited to the amount you paid us in the 12 months preceding the claim.
  • Indemnification: You agree to indemnify and hold harmless HUMANOVA LABS LLC against any claims or legal fees arising from your User Content (e.g., copyright violations, illegal recordings) or your breach of these Terms.
  • Force Majeure: We are not liable for service interruptions due to events beyond our control (e.g., cloud provider outages, wars, natural disasters).

7. App Store Requirements

If you downloaded the App from the Apple App Store, you acknowledge that:

  • These Terms are between you and Pandanote, not Apple.
  • Apple has no obligation to provide support or maintenance.
  • Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • US Embargo: You represent that you are not located in a country subject to a U.S. government embargo or listed on a ""terrorist supporting"" country list.

8. Changes and Governing Law

Governing Law: These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. For users in the EU/UK/Australia, strictly mandatory local consumer protection laws may take precedence where applicable.

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the new Terms.
